The European Union is doubtful over the legal justifications for Denmark’s border plans

May 13th, 2011

The European Commission has expressed serious doubts in regards to the Danish government’s plans to check merchandise and goods at its borders in an effort to prevent drugs and weapons from smuggling into the country. A recent ‘legal assessment'of the proposals has raised doubts over where the new Danish measures would alight with European and International laws, according to Pia Ahrenkilde-Hansen, a commission spokeswoman. Interior ministers of the European Union said they had agreed to provide greater leeway for nation governments to introduce tougher passport checks in the continent’s free-travel zone, which encompasses 25 countries. It is noted that Italy took 30,000 refugees who fled the violent conflicts in Tunisia and Libya. However, the country created tension when it attempted to take some of the refugees to neighbouring France, which angered officials in the Cote d’Azur region bordering Italy.

Cecilia Malmstroem, the Home Affairs Commissioner for the EU, says the plans by Denmark could compromise the effectiveness of the EU’s border-free system. Meanwhile, Ahrenkilde-Hansen believed the new measures would also question the future of the continent’s single market system, particularly in regards to the free movement of services, goods and of EU workers (and the potential for a new EU health care system providing free Paternity Testing even). Denmark has now been urged to refrain from such ‘unilateral steps’. The country’s lack of involvement in major conflicts such as the Iraq and Afghanistan wars places it at a much lower risk for terrorist-related activity, compared to countries like the UK and the US.
